1. Service Description

Welcome to milddisparity.info, a software-as-a-service (SaaS) platform operated by Milddisparity. Our services include a suite of tools designed to enhance productivity and streamline operations for businesses of all sizes. By accessing or using our services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

Milddisparity reserves the right to modify, suspend, or discontinue any aspect of the services at any time without prior notice. We will make reasonable efforts to notify users of significant changes, but it is your responsibility to review these Terms periodically for updates. Your continued use of the services following any changes constitutes your acceptance of the new terms.

Our services are intended for users who are at least 18 years old. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. User Accounts

To access certain features of our services, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Milddisparity immediately of any unauthorized use of your account or any other breach of security. Milddisparity will not be liable for any loss or damage arising from your failure to comply with this section.

We reserve the right to suspend or terminate your account at our sole discretion if we suspect any unauthorized use or if you violate these Terms. Upon termination, your right to use the services will immediately cease, and you must cease all use of the services.

3. Acceptable Use Policy

By using our services, you agree to comply with all applicable laws and regulations. You agree not to use the services for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the services or interfere with any other party's use of the services.

You agree not to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the services, or which, as determined by Milddisparity, may harm Milddisparity or users of the services or expose them to liability. This includes, but is not limited to, the following:

Using the services in a manner that violates any applicable local, state, national, or international law or regulation.
Transmitting any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
Attempting to gain unauthorized access to any portion of the services or any other systems or networks connected to the services.

4. Prohibited Activities

In addition to the Acceptable Use Policy, you are expressly prohibited from engaging in the following activities:

Using the services to transmit any unsolicited or unauthorized advertising, promotional materials, spam, junk mail, or any other form of solicitation.
Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
Using any robot, spider, or other automatic devices, process, or means to access the services for any purpose, including monitoring or copying any of the material on the services.
Engaging in any other conduct that restricts or inhibits anyone's use or enjoyment of the services, or which may harm Milddisparity or users of the services or expose them to liability.

5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Milddisparity or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use terminates the permission or license granted by Milddisparity. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

Our services may allow users to submit, post, or transmit content, including but not limited to comments, feedback, and suggestions ("User-Generated Content"). By submitting User-Generated Content, you grant Milddisparity a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not infringe upon the rights of any third party. Milddisparity is not responsible for any User-Generated Content and does not endorse any opinion contained in such content.

Milddisparity reserves the right to monitor, edit, or remove any User-Generated Content at its sole discretion. We may take action against any User-Generated Content that violates these Terms or is otherwise objectionable, including but not limited to removing the content or terminating your account.

7. Payment Terms

Access to certain features of our services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated in these Terms or required by law.

Payment will be processed through a third-party payment processor. You agree to provide accurate and complete billing information and authorize Milddisparity or its payment processor to charge your payment method for the fees incurred. You are responsible for maintaining the confidentiality of your payment information and for all transactions made under your account.

In the event of a payment dispute, you must contact us within 30 days of the charge. If you fail to do so, you waive any right to dispute the charge. Milddisparity reserves the right to change its pricing at any time, but any changes will not affect fees already incurred.

8. Service Modifications

Milddisparity reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Milddisparity will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for updates. Your continued use of the services after any modifications constitutes your acceptance of the modified Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Milddisparity, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of, or inability to access or use, the services;
Any conduct or content of any third party on the services;
Any content obtained from the services; and
Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Milddisparity’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

10. Termination

These Terms are effective until terminated by either party. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Milddisparity may terminate or suspend your access to the services immediately, without prior notice or liability, if you breach these Terms or if we believe you are engaging in any conduct that violates applicable law or is harmful to the services or other users.

Upon termination, your right to use the services will immediately cease, and you must cease all use of the services. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of these Terms does not affect any rights or obligations that have accrued prior to the date of termination.
